Terms of Use

1. These terms

These Terms of Use are an agreement between you and NaughtySpirit (“we”, “us”), based in Bulgaria, for the ShiftDeck app and its share pages. By downloading or using ShiftDeck you accept them. If you do not accept them, please do not use the app. Our Privacy Policy explains how we handle data.

If you got ShiftDeck from the App Store, Apple's standard Licensed Application End User License Agreement also applies, and these terms add to it. These terms are between you and us, not Apple. Apple is not responsible for ShiftDeck, its content, maintenance, support or any claims about it, and Apple and its subsidiaries may enforce these terms as third-party beneficiaries. If you got ShiftDeck from Google Play, Google Play's terms also apply.

2. What ShiftDeck is

ShiftDeck is a personal tool for planning shift work: it works out your shifts from the pattern you enter, sets alarms, counts hours and shows pay estimates and rest advice. It is not your employer's scheduling system. If your employer's rota, a change you were told about, or your contract differs from what ShiftDeck shows, the employer's information is the one that counts. Check important dates against it.

3. Alarms

ShiftDeck sets alarms through your phone's own alarm features. We work hard to make them reliable, but whether an alarm rings also depends on things we do not control, including your phone's settings and permissions, battery saving, Focus and Do Not Disturb modes, volume, operating system updates, and whether the phone is charged and switched on.

  • Check Alarm health after installing, after phone updates and when you change settings. It explains how to fix each problem it finds.
  • Make sure the alarms match your real shift times, especially after swaps or changes from work.
  • For shifts you cannot afford to miss, set a second alarm on another clock or device.

To the extent the law allows, we are not responsible for a missed or late shift, or its consequences, because an alarm did not ring or rang at the wrong time.

4. Hours, pay and recovery advice

Paid hours, night hours, overtime and pay figures are estimates based on the rates and rules you enter. They are not a payslip and not payroll, tax or legal advice. Check your pay with your employer.

The recovery plan gives general sleep and light advice based on published research about shift work. It is not medical advice and does not replace a doctor. If you often feel very sleepy, or sleepy while driving, talk to a doctor.

5. Your data and backups

You own the schedules, notes and other content you create. We only use it to run the features you use, as the Privacy Policy explains. Your data is stored on your phone, and a phone can be lost, reset or broken, so save a backup file from time to time. Read printed rosters imported from a photo carefully before you apply them. To the extent the law allows, we are not responsible for data lost on your device or for decisions based on an import you did not check.

6. Accounts

An account is optional. If you create one, give a real email address you can access, keep your password safe, and tell us at support@retroselfie.me if you think someone else has used your account. One account is for one person. You can delete your account at any time in Settings, Account and sync, Delete my account and online data.

7. Sharing and teams

You decide what you share. Anyone with your partner link or QR code can see the shifts it shows, so share it only with people you trust, and stop sharing whenever you want. In a team, you are responsible for the team name and display name you choose and for the shifts and swap requests you send. Agreeing a swap in ShiftDeck does not change your official rota: arrange swaps with your employer as your workplace requires. If you delete your account, teams you created are removed for their members too.

8. Free version, trial and unlock

  • Free version. ShiftDeck's core features are free and show no ads.
  • Trial. For your first 7 days, every paid feature is on, with no payment details and nothing to cancel. When the trial ends, paid features lock again and your data stays.
  • Unlock. The optional unlock is a one-time, non-subscription purchase through the App Store or Google Play, at the price shown in the store before you buy. It unlocks the paid features listed in the app for as long as ShiftDeck is offered, on the devices signed in to the same Apple or Google account. On the App Store it can be shared through Family Sharing. Restore purchases in the app brings it back on a new phone.
  • No subscription. Features included in your unlock stay included. We will not later ask you to subscribe to keep them.
  • Payments and refunds are handled by Apple or Google under their own terms. Ask them for refunds. This does not affect your statutory rights as a consumer.

9. Acceptable use

You agree not to:

  • use ShiftDeck to break the law or to harass, impersonate or harm others, including through team names or display names;
  • try to access another person's account, schedule or team without permission;
  • interfere with or overload our servers, or get around the unlock or other limits;
  • copy, decompile or reverse engineer the app, except where the law allows it.

10. Licence and ownership

We give you a personal, non-exclusive, non-transferable licence to use ShiftDeck on devices you own or control, under these terms and the store terms. The app, its design, text and code belong to NaughtySpirit and its licensors. The research cited in the recovery plan belongs to its authors.

11. Changes and availability

We may improve, change or remove features over time. Online features such as sync, sharing and teams may sometimes be unavailable, and the app keeps working offline when they are. If we ever stop offering ShiftDeck, we will give reasonable notice where we can, and the app and your backup file will keep working on your phone without our servers.

12. Warranties and liability

ShiftDeck is provided “as is” and “as available”. To the extent the law allows, we do not promise that it will be error-free or uninterrupted, and we are not liable for indirect or consequential loss, such as lost earnings, missed shifts or disciplinary action at work. Where the law allows us to limit our liability, our total liability to you is limited to the amount you paid for ShiftDeck. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing affects your rights as a consumer under the law of the country where you live.

13. Ending

You can stop using ShiftDeck at any time by deleting the app and, if you have one, your account. We may suspend or close an account that seriously or repeatedly breaks these terms. If we do, you keep the schedule on your phone.

14. Changes to these terms

When we change these terms, we update the date at the top of this page. If a change is significant, we will tell you before it takes effect, in the app or by email. Using ShiftDeck after a change takes effect means you accept the new terms.

15. Governing law

These terms are governed by the law of Bulgaria. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. EU consumers can also use their national consumer bodies or out-of-court dispute resolution.
