Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the mobile application Neon Ricochet (“the App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

Neon Ricochet is an arcade-style game made available for compatible iOS and Android devices. The publisher may be identified as NaughtySpirit or as otherwise shown in the store listing. Features (such as leaderboards or optional purchases) may vary by platform, region, or App version.

2. Eligibility

You must comply with the age and account requirements of the Apple App Store and Google Play, and any minimum age we specify in the store listing. If you use the App on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

3. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use the App for your private, non-commercial entertainment. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the App, except to the extent permitted by mandatory law.

4. Acceptable use

You agree not to:

  • Use the App in violation of law or third-party rights;
  • Cheat, exploit bugs, automate play, or interfere with leaderboards or other players' experiences;
  • Attempt to disrupt servers, networks, or security features;
  • Use the App to distribute malware or harass others when using sharing features.

5. In-app purchases and ads

Some versions of the App may offer in-app purchases or display advertisements. Purchases are processed by Apple or Google; billing, refunds, and payment disputes are handled under their policies. Virtual items have no real-world monetary value and may be changed or discontinued. Advertising may be provided by third-party networks subject to their terms and your device settings.

6. Third-party services

The App may integrate Apple Game Center, Google Play Games, sharing extensions, or other platform services. Your use of those services is subject to the applicable third-party terms and privacy policies. We are not responsible for third-party services or content.

7. Intellectual property

The App, including its name, visuals, audio, and underlying software, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license above, no rights are granted to you.

8. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP OR IN-APP PURCHASES IN THE SIX MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE PROHIBITED BY LAW.

10. Indemnity

You will defend, indemnify, and hold harmless the publisher and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the App or violation of these Terms, except to the extent caused by our willful misconduct.

11. Termination

We may suspend or terminate your license if you breach these Terms or if we discontinue the App. You may stop using the App at any time by uninstalling it. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.

12. Changes

We may modify these Terms by posting an updated version in the App or on this page. Material changes will be indicated by updating the “Last updated” date. Continued use after changes constitutes acceptance. If you do not agree, stop using the App.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which the publisher is established, excluding conflict-of-law rules, unless mandatory consumer protection laws in your country of residence require otherwise. Courts in that jurisdiction have exclusive jurisdiction, subject to mandatory rights you may have as a consumer.
